Sentence history points to confirmation of sentence

The statistics are not in Robinho's favor in the gang rape case. The player, who was sentenced to nine years in prison in the first instance trial in Italy, has his next hearing scheduled for early December.

However, the history of second instance sentences at the Milan Court, where the case is ongoing, points to confirmation of the sentence.

According to data available on the Italian Ministry of Justice website, among all criminal cases tried in the second instance in the period from 2011 to 2019, approximately 7,5% of convictions were converted into acquittals.

On the other hand, 44,3% of penalties were maintained. In the remaining 48% of cases, either innocence in the first instance was maintained or defendants previously considered innocent were convicted. The numbers refer to Milan.

Robinho claims to be innocent

The case has been under the responsibility of Italian authorities since 2013. According to investigations, Robinho and five friends allegedly raped a young Albanian woman in a dressing room at the Milanese nightclub Sio Café, where she was celebrating her birthday.

The case happened on January 22, 2013, when the athlete defended the Milan. In addition to the nine-year sentence, the attacker must pay the victim compensation of R$400 (60 euros) if the sentence is upheld. Robinho claims to be innocent and to have had consensual sex with the woman.

A report on the GE.Globo website revealed details of the first instance conviction.

Transcripts of telephone interceptions carried out with judicial authorization showed that Robinho admitted to having participated in the act of gang rape.

In 2017, the Italian court relied mainly on these recordings to find the attacker guilty in the first instance.

The hearing before the Court of Appeal, the second Italian instance, is scheduled for December 10th.

The player's presence, however, is not guaranteed. When contacted by Estadão, lawyer Franco Moretti, who represents Robinho in the case, stated that he will not give interviews, statements or information.

After pressure from sponsors and fans, Santos chose to suspend the contract with the player.
