Rape: telephone interceptions authorized by the Italian court were considered fundamental

Telephone interceptions authorized by the Italian court, considered fundamental for the first instance conviction of Robinho, 36, for rape in 2017, were revealed this Friday (16) by the website globoesporte.com (GE).

In November 2017, the Milan Court judged the accusation of the Italian Public Prosecutor's Office that Robinho participated, with five other men, in collective sexual violence against a 23-year-old Albanian woman in a nightclub in Milan. The episode occurred in January 2013, when he was 28 years old and playing for Milan.

Could Robinho be arrested or extradited?

Despite the crime, Robinho cannot be extradited at the request of the Italian justice system, which in 2017 sentenced the player to nine years in prison for participating in a gang rape against a young Albanian woman in 2013, in Milan, at the time he was defending the Milan. The Brazilian constitution, in article 5, prohibits the extradition of native Brazilians.

Moreover, he may be arrested in Brazil to serve the sentence he received in Italy. To do so, the Italian court would have to contact the Brazilian court and request an analysis of the crime committed in Italy. If the Brazilian justice system considered that the crime committed in Italy falls within the Brazilian Penal Code, he would be arrested in the country.

At the time, Robinho denied participation in the crime. Because of the condemnation, he is banned from entering Italy or in countries with which the Italian government has an automatic extradition agreement.

In transcripts of telephone interceptions made with judicial authorization, the player Robinho revealed his participation in the act that led a 23-year-old Albanian woman to accuse the athlete and friends of gang rape, in Milan, Italy.

Based mainly on these recordings, the Brazilian was sentenced in the first instance to nine years in prison for the crime.

Details of the process were revealed this Friday (16) by the website “Globoesporte.com“. According to the investigation, the woman was taken to a dressing room at the nightclub, where she was abused by five men, including Robinho and Ricardo Falco, her friend.

The case took place in a nightclub in Milan called Sio Café, on January 22, 2013. In addition to making telephone recordings, the Italian police installed a bug in Robinho's car and managed to capture other conversations.

In one of the police interceptions, the player says: “I'm laughing because I don't care, the woman was completely drunk, she doesn't even know what happened.”

Suspended contract

Santos and striker Robinho announced this Friday (16) the suspension of the contract between club and player, who had agreed on his return on October 10th.

The bond was valid for five months and would be discussed at a meeting of the Deliberative Council on the 21st.

The decision comes after pressure from advisors, sponsors and the revelation of excerpts from the court's sentence. Italian justice which sentenced Robinho and a friend in the first instance to nine years in prison for group sexual violence against a young woman of Albanian origin.
