When the State's recklessness generates citizenship processes considered false
Teramo, Ospedaletto, Pavia, Syracuse, and now Verbania and Novara. The headline is the same: Brazilians suspected of falsifying Italian citizenship.
The reason? The same as always: accused of establishing false residences in Italy.
But how long do you have to live in Italy to not have your residence classified as illegal?
There is no pre-established timeframe in the circulars that regulate the Italian citizenship process.
Having residency in Italy is one of the requirements for those entitled to Italian citizenship to apply for recognition on Italian soil – and consequently avoid the illegal queues at Italian consulates that can exceed 10 years of waiting.
If there is no law that determines a minimum time to establish residence, then is one day enough?
As there are no clear rules, it is not possible to punish the applicant alleging that he used such a “trick” to mislead Italian officials. An assertion without rational basis, hostile and prejudiced.
If the communal officer confirmed residency – the vigile passed within 45 days – the residency requirement is met.
Due to the inaction and recklessness of the Italian State, the issue becomes interpretative. And, surely, in a discussion in court, the citizen will be acquitted and the Italian State must compensate him.
It is time for our Italian deputies, elected in Brazil and South America, to work for the benefit of their voters. It is high time to create clear and unified rules for the issue of residences.
