A Moroccan lawyer was expelled from a court in Bologna, northern Italy, on Wednesday (17) for wearing the hijab, an Islamic veil that covers the hair and neck.
The episode took place at the Regional Administrative Court (TAR) in the capital of Emilia-Romagna, when judge Giancarlo Mozzarelli asked Asmae Belkafir, 25 years old, to remove her clothes or leave the court. The lawyer refused to go without her veil and ended up leaving the room.
At the entrance to the court, there is a sign warning that people present at trials must be “face uncovered and silent”. Belkafir works in the law office at the University of Modena and Reggio Emilia, where he obtained his degree. Some acquaintances say that she has participated in countless sessions in Italian courts, always wearing the hijab, which leaves her face exposed.
In addition to the controversy between political parties, which are in the midst of an electoral campaign, the stance of the Bologna TAR generated a reaction from the Council of State, the highest administrative justice body in Italy and whose president, Alessandro Pajno, asked for clarification on the case.
The judge involved in the episode refused to speak to the press. However, his superior, Giuseppe Di Nunzio, president of the Bologna TAR, authorized Belkafir to return to court wearing the hijab.
In several European countries, there are restrictions against the burqa, which covers the entire body, and the niqab, which only shows the eyes, but there are no rules that prevent the hijab, as it does not hide the woman's face.
