The procedure for requesting the execution of sentences against football player Robinho and his friend Ricardo Falco for sexual violence was registered at the Milan Public Prosecutor's Office this Monday (31).
The process begins 12 days after the confirmation of the nine-year prison sentence handed down by the Court of Cassation, Italy's highest court.
As stipulated by the regulations of the Italian justice, the Prosecutor's Office's execution office will formulate the extradition request with a simultaneous international arrest warrant in the coming days.
The acts of the highest court have already reached the MP and the execution process is under the leadership of prosecutor Adriana Blasco.
After collecting some documents to confirm the identity of the two convicts, the execution phase will begin with the transmission of the extradition request to the Italian Ministry of Justice, formal notification to the Brazilian authorities and the issuance of the arrest order.
Brazil is unlikely to extradite Robinho and Falco because the country's constitution does not allow citizens to be sent to serve sentences in other nations, but with the international arrest warrant open, the convicts could be arrested if they travel to another country that has similar agreements with Italy.
Currently, around 70 nations have this type of partnership with the Italians, including Argentina, Australia, Canada, the United States, the United Kingdom and all members of the European Union.
Robinho and Falco were sentenced in the first instance in November 2017, in the second instance in December 2020 and had their sentence confirmed on January 19th. Both were convicted of group sexual violence against a young Albanian, 22 years old at the time of the events, which occurred in a club in Milan on January 22, 2013. (Handle)
