Brazil has refused to extradite former striker Robinho, sentenced in Italy to nine years in prison for rape.
The decision was based on article 5 of the Federal Constitution, which prohibits the extradition of Brazilian citizens.
The information is from the Italian news agency “Handle“. The European country's government plans to request the sentence be served in Brazil.
The extradition request was made in February, after the conviction. However, it was only in October that he was forwarded to the Brazilian authorities. Now, about a month later, Brazil's refusal was reported by the Italian press.
According to the 1988 Constitution, the country does not extradite native Brazilians. Robinho's sentence is final, of last resort in the Court of Cassation (the equivalent of the Brazilian Federal Supreme Court), and the athlete can no longer appeal.
Remember the case
Robinho and five other people were convicted in the first instance in Italy for sexual violence. Robinho was even absent from Istanbul Basaksehir's match against Roma in the Europa League in 2019. As the match was held in Italy, the Brazilian feared the risk of being arrested, according to the Spanish newspaper "As".
The episode for which Robinho was convicted occurred on January 22, 2013. The convicts were accused of sexually abusing a 22-year-old woman outside a nightclub. In 2017, Robinho was sentenced to nine years in prisono, despite stating that he had “no participation” in the rape.
In audios captured by the country's courts during investigations, it is possible to note that Robinho admits to having had oral sex with the young woman. The conversations were with Ricardo Falco, another person convicted in the action.
