The Court of Cassation in Rome, the third and final instance of Italian justice, will judge the Robinho case in a hearing on January 19th, starting at 10 am.
The trial will focus on the appeal presented by the player's defense, which is trying to change the sentence to nine years in prison for the crime of group sexual violence – Ricardo Falco, Robinho's friend, was also convicted.
The two and three other people, who were not identified by the Italian justice system, sexually assaulted a young Albanian woman at the Sio Café nightclub, in Milan, on January 22, 2013.
At the time of the crime, the attacker was in the third of four seasons he had with the club's shirt. Milan, and was still a frequent presence at the convocations of the Brazilian Team.
The sentence must be issued on the same day and will be final., with no possibility of appeal.
If the conviction is confirmed, Italian justice may request the attacker's extradition. The Brazilian Federal Constitution, however, prohibits the extradition of native Brazilians.
Another alternative would be a request that Robinho serves his prison sentence in Brazilian territory.
The case will be analyzed by a panel of five judges, including the president of the Court, of the third penal session. As in the first and second instances, the hearing will be public.
Robinho admitted to having had sexual relations with the victim, whose name was not disclosed, but denied the accusations of sexual violence when questioned in 2014.
He did not attend any of the hearings during the nearly six years of the trial.
The case, which began in 2016, had the first degree sentence handed down on November 23, 2017. On December 20, 2020, the Court of Appeal of Milan, the second instance of Italian justice, in a single and brief hearing, confirmed sentencing the attacker and Falco to nine years in prison. (UOL)
