Law amends the Penal Code and expands the possibilities of self-defense

The project of the League, the right-wing party of Vice Prime Minister Matteo Salvini, was definitively approved on March 28 by the Italian Senate, with 201 votes in favor and 38 against, in addition to 6 abstentions.

“It must first be emphasized that the new legislation does not weaken the State's primary and exclusive responsibility for the protection and security of citizens, exercised and ensured through the generous and effective action of the Police Forces”, stated President Sergio Mattarella.

The main change in the reform is a change in article 52 of the Penal Code, establishing that the “proportionality between offense and defense always remains” if the aggression takes place in the victim's home or work, reports the ANSA agency.

The project also says that the defense “is always legitimate” in cases of “invasion with violence or threat”.

Another change determines that a person cannot be convicted of “excessive self-defense” if they are protecting themselves from an attack in their home.

During a recent visit to the European country, federal deputy Eduardo Bolsonaro (PSL-SP) spoke extensively with Salvini and received a copy of the self-defense law from the hands of the Italian minister.
