What you need to know about the new Nationality Law in Portugal

In a historic vote this Wednesday (01/04), the Portuguese Parliament approved severe restrictions on the new Nationality Law. The residency period has increased, the right by birth has been limited, and the counting of waiting time has been eliminated.

The end of the "waiting count" (setbacks in deadlines)

This is the most critical point for those awaiting regularization. The article that allowed the waiting time for a residence permit (formerly known as Expressions of Interest) to be counted towards the nationality application has been removed.

  • How was: The time counted from the day the residency application was submitted.

Increased residency period (CPLP)

Citizens of the Community of Portuguese Language Countries (including Brazilians) saw the deadline increase:

  • Before: 5 years of residency.
  • Now: 7 years Proof of residence with a valid title to apply for citizenship.
  • For other nationalities, the deadline has been extended to 10 years.

Restrictions for babies born in Portugal

The ease of obtaining citizenship through children born on Portuguese soil has ended.

  • Now, parents will be required to have at least 5 years of residency with a degree so that the baby is entitled to Portuguese nationality at birth.

Loss of nationality and crimes

The new law introduces the loss of nationality for naturalized citizens who commit serious crimes or are sentenced to prison terms equal to or greater than 3 years.

When it comes into force

The text was sent to the President. Antonio José SeguroHe has 20 days to review it. If approved, it will come into effect the day after its publication in the Official Gazette.

Important: The law is not retroactive. Processes already initiated follow the old rule, but those who have not yet filed will be affected by the new deadline requirements.
