The Constitutional Court of Italy has decided to reject the participation of Trentino Circle of Sao Paulo and Domus Sardinia Circle in the trial regarding the constitutionality of the current Italian citizenship law. The case will be officially analyzed in June 24.
The associations represent descendants of Italian emigrants and claimed to have a direct interest in the action. The Court, however, considered the requests inadmissible based on established case law: only those who demonstrate a direct legal link with the main proceedings can intervene.
According to the court, in a ruling released on Monday (20), the constitutional judgment is reserved for the parties directly involved in the case, the President of the Council of Ministers and, when relevant, the president of a region. Having similar interests or representing potentially affected categories is not enough.
According to lawyer Antonio Cattaneo, consulted by Italianismo, "no surprise". For him, the decision was quite predictable, although the associations in question represented a category of descendants potentially affected by the judgment of unconstitutionality of the law on Italian citizenship.
According to Cattaneo, the Court's understanding allows entities like these to contribute with technical opinions, “as long as they act as amicus curiae” — legal figure that authorizes collaboration without formal intervention in the process.
At the hearing on the 24th, the Court will also assess requests for intervention from two other entities: AGIS and AUCI, which represent lawyers specializing in Italian citizenship.
