The Italian Constitutional Court will hold a public hearing next Tuesday, June 9th, regarding challenges to the new Italian citizenship rules, approved in 2025. The session will be streamed live online on the court's official channel. on the Vimeo platform.
The hearing is scheduled to begin at 15 PM Rome time. In Brazil, the broadcast will start at 10 AM Brasília time. The public can follow along via the link provided by the Court.

Session opens public phase of debate.
The hearing is part of the Constitutional Court's analysis of legal challenges raised against recent changes to citizenship legislation. The court is examining three cases that discuss the validity of the rules approved in 2025. Two cases are from the Campobasso court. The other is from Mantua.
In this stage, the lawyers orally present the parties' arguments before the judges. The representative of the Italian State also participates.
The outcome is being closely watched by descendants who are seeking recognition of their Italian citizenship.
Among the lawyers presenting arguments are Marco Mellone, PhD in European Union Law, Corrado Caruso, professor at the Università di Bologna, and Alfonso Celotto, Roma Tre University.
The session will not result in a final decision. After the oral phase, the judges begin internal deliberation. There is no fixed deadline for the publication of the sentence. The interval may vary from a few weeks to several months.

Ordinanza nº 4/2026, from Mantova
This case concerns a Brazilian minor who, under the previous rule, would have acquired Italian citizenship at birth. The court questions whether the new law can assert that he never acquired citizenship, even after the judicial recognition of his mother as an Italian citizen.

The case discusses two Argentinian brothers. The central point is the retroactive application of Law No. 74/2025. The court questions whether citizenship, understood as an original and permanent status, can be revoked from descendants who would already have been entitled to it under the previous rules.

The case involves two Brazilian women of Italian descent born in Molise. In addition to questioning the new citizenship rule, the lawsuit discusses the procedural limitations created by the law and its effects on access to justice.
