The expression "sham citizenship" marked the first session of the extradition trial of the former federal congresswoman. Carla Zambelli, held this Wednesday, the 11th, at the Court of Appeals in Rome.

According to lawyer Pieremilio Sammarco, Italian prosecutor Erminio Amelio stated that Zambelli's Italian citizenship would be "Just a facade."

“He stated verbatim that Zambelli’s Italian citizenship is ‘just a facade’ and that, formally, she is Italian, but substantially not. It’s a legal absurdity that I strongly contested in a hearing immediately afterward, when I took the floor yesterday,” declared Sammarco.

Debate on jus sanguinis

Zambelli obtained Italian citizenship based on the principle of jus sanguinis, the right of blood, due to his Italian origin.

The defense argues that the prosecutor's statement, although made in a specific case, reveals a lack of knowledge about the legislation that recognizes Italian citizenship by descent.

The topic has been widely debated in Italy, which is discussing restrictions on granting citizenship to descendants.

Strategy in the process

The Court has precedents that prevent extradition in cases of conviction for political crimes. Common crimes are not included in this understanding.

The defense strategy is to demonstrate that the trial in Brazil was political in nature.

Sammarco tries to include the expert as a witness. Eduardo Tagliaferro, former special advisor for combating disinformation at the Superior Electoral Court. The defense claims that he can confirm that Zambelli is suffering political persecution in Brazil, especially from Supreme Federal Court Justice Alexandre de Moraes.

The court decided not to hear Tagliaferro's testimony at this time. After analyzing the arguments, the judges will decide whether the testimony will be considered useful.

Conviction in Brazil

Sentenced to 10 years in prison by the Supreme Federal Court, Carla Zambelli was accused of paying the hacker Walter Delgatti Neto, known as the "Araraquara hacker," to break into the systems of the National Council of Justice.

According to the prosecution, the break-in resulted in the issuance of a false arrest warrant signed by Alexandre de Moraes, in which he himself was listed as a defendant.
