Silmara FabottiThe woman, identified as the leader of a scheme involving false residency to obtain Italian citizenship, allegedly planned to flee Italy, according to the judge's ruling in the case.
Wiretaps revealed — as published by the newspaper Internapoli — that Fabotti and his right-hand man, Flavio Alan Yogui, maintained frequent contacts with foreign countries, including the United Arab Emirates, raising fears that they could try to escape legal proceedings.
These indications led to the decision to preventive detention for the two, while others involved, including municipal employees, were placed under house arrest.
Civil Registration Office employees (Stato Civile)Alessio De Rosa, Alessandro Di Vivo, Antonio Opera, and local police officer Antonio Amato were accused of being part of a criminal organization dedicated to the recognition of residences within the territory of the Municipality of Villaricca and the recognition of Italian citizenship, in collusion with Silmara Fabotti, considered the mastermind of the scheme, and her right-hand man, Flavio Alan Yogui.

Naples Public Prosecutor's Office wanted arrest for all those investigated
The Naples Public Prosecutor's Office had requested the arrest of all six suspects. However, the preliminary investigation judge opted for less severe measures, ordering house arrest for the three members of the Marital status and to the Local Police officer involved in the investigation.
“The intercepted conversations revealed a bleak picture, where public servants failed in their duties of loyalty to the public interest and, dissatisfied with their monthly salary, made a profit — and continue to do so to this day — by betraying and instrumentalizing the control duties assigned to them. were entrusted, placing themselves at the service of Silmara Fabotti and her executor, Flavio Alan Yogui,” writes the judge in the final pages of the decision.
According to investigations, it was a system with a division of roles and numerous irregularities found in 2021 processes.
Municipal Police agent Antonio Amato was described in the judge's decision as “corrupt and willing to go against his commander's directives to continue the illicit activity, asking Alessandro Di Vivo and Alessio De Rosa to separate the Fabotti processes”.
Meanwhile, municipal employee Antonio Opera "went so far as to grant Italian citizenship before the verifications, frequently visiting the Marital status, which in reality became the headquarters of a criminal association, to ask if there was illicit work for him.”
During the interceptions, the willingness of municipal employee Alessio De Rosa “to continue working in Fabotti's interests even after retirement” also emerged.
The judge explains that “De Rosa, Di Vivo and Amato were caught trying to devise strategies to remedy their misdeeds, displaying an inexplicable confidence in the inability of the forces of order to discover the irregularities, demonstrating the absence of regret or understanding of the serious damage caused to the organ with your actions.”
In light of this, the judge considered it appropriate to limit the freedom of the municipal employees involved by placing them under house arrest.

A different approach was taken for Silmara Fabotti, considered "the mastermind behind the sale of Italian citizenship, using her trusted associate Flavio Alan Yogui, who worked in the Villaricca Municipality registry office as an employee, but for exclusively personal and illicit purposes," says the judge.
For the two Brazilians, arrest was ordered due to evidence in the interceptions of numerous contacts with foreign countries, including the United Arab Emirates, which could have been used to escape prosecution.

In short, less severe measures would not have prevented those under investigation from resuming the criminal activity to which they had dedicated themselves for years, obtaining profits considerably higher than those revealed by the investigations, says the Neapolitan newspaper.
Rodrigo faro, from TV Record, and his wife, Vera Viel, businessmen, football players and other celebrities were named in the investigation.
