“We were born Italian and we will continue to be Italian.” With this statement, the Italian-Brazilian lawyer and politician Luís Roberto Lorenzato celebrated the decision of the Italian Constitutional Court, which reaffirmed the validity of the right to citizenship by descent.jure sanguinis).
Sentence No. 142/2025, published this Wednesday, July 31stThe court deemed inadmissible and unfounded the actions brought by courts in Bologna, Rome, Milan, and Florence, which sought to impose limits on the automatic recognition of citizenship for children of Italians born outside the country.
The decision reinforces the understanding that Italian citizenship is transmitted through lineage, regardless of residence or territorial connection to Italy.
In a video published on social media, Lorenzato highlighted the importance of the decision:
"Hello everyone, the Constitutional Court has finally issued its ruling declaring the postponement by the courts of Bologna, Florence, and Rome inadmissible. Therefore, the right of blood is valid for all of us, as we have always maintained. We were born Italian and we will continue to be Italian," he said.
He also criticized the government's attempt to restrict access to citizenship for descendants living outside Europe: "Whether the Prime Minister, the government, the Farnesina, and Tajani like it or not, the important thing is that we won and now we move on to a new stage of the new cases that are going through the courts. Congratulations to everyone, greeting and long live Italy, because Italy must still be respected for its Justice”, he concluded.
The decision is considered a significant victory for the Italian-descendant community, especially in the Americas, where thousands of cases were suspended awaiting the Court's decision.
