Letter sent to the European Commission highlights risks to European citizenship and calls for review of new Italian legislation

The Comites di Losanna in Switzerland has requested constitutional review of the new Italian citizenship law, specifically Article 3-bis of Law No. 91 of 1992. The recently approved law determines that people born abroad and holding another citizenship are no longer considered Italian. jure sanguinis, except in specific cases.

According to the news agency AISE, the objection was formalized by means of a letter signed by the president of the Committees, Michele Scala. The document was sent to the European Commission and the Council of Europe.

According to Scala, the legal change is "unfair and discriminatory," especially for descendants of Italians living in Europe. He believes the new rule violates the principle of equality and violates international treaties on nationality and human rights.

European Union must assess possible violation of rights

The Committees' most emphatic criticism (Committees of Italians Abroad) refers to the possible incompatibility of the new law with European Union law. Scala argues that the automatic loss of Italian citizenship it would also imply the loss of European citizenship, with direct impacts on freedom of movement, the right to work and consular protection.

The letter also highlights the potential violation of the principle of proportionality and the best interests of the European citizen, which are the legal foundations of the EU. It also mentions articles of the Italian Constitution, such as Article 22, which prohibits the withdrawal of citizenship for political reasons, and the European Convention on Nationality, signed in 1997.

Among the specific requests are the opening of a constitutional verification procedure and the automatic recognition of the right to citizenship for those who have already initiated the administrative or judicial process before March 27th, 2025.

"Citizenship is not just a bureaucratic act," Scala stated. "It is the recognition of a deep connection to our national history. To break this bond is to deny an essential part of our collective identity."
