The requirement for prior knowledge of the Italian language through a proficiency test is in force for naturalization processes.

Hastily made, rule affects candidates for naturalization. The exam will have to be attached along with other documentation at the beginning of the process.

The candidate for naturalization will need to reach at least level B1 — which is equivalent to intermediate — for the process to be completed. The rule applies both to those who live in the European country and to those who have started their Italian naturalization in Brazil.

As is customary in Italy, the Salvini Decree was standardized, but without a prior technical study.

The Ministry of the Interior sent the circular – with the unfortunate number 666, which was promptly nicknamed “the beast's circular” – to Italian communes and consulates last Friday (25).

But so far the Italian embassy in Brazil, which manages the six consulates, has not made the information available on its page. The requirement appears on the websites of the consulates of São Paulo, Paraná and Porto Alegre, but without any details.

The Italian test for naturalization processes will have to be attached along with other documentation at the beginning of the process. And that's where the problem starts.

Brazil has only four certifying entities

Currently, in Brazil, only four certifying entities – present in 21 cities in 10 states – belong to the unified certification system. In-person tests take place twice a year, and cost an average of R$400.

Sources consulted by Italianismo believe that the Ministry of the Interior will have to make some adjustments to the distributed circular. It should contain clear information and possibly include permission for the certificate to be delivered at the end of the process, that is, on the date the applicant must take the oath at the consulate.

On the other hand, they also believe that the requirement will apply to processes initiated before the Salvini Decree was made official. Italy does not have the institute of acquired rights like Brazil does.

This new regulation only affects people who do not have any relationship with Italians in their bloodline — that is, those who seek naturalization through marriage or those who do so through time of residence in Italy.

People who have some ancestor in their lineage — without limit of generations — are considered Italian citizens from the first day of life, even if they were born in foreign countries, they can apply for citizenship without going through these proficiency procedures, because they are under the guardianship of the jus sanguinis (right of blood).
