Supreme Federal Court (STF) Minister Cármen Lúcia voted this Saturday (16) to maintain the arrest of former soccer player Robinho.
With this vote, the STF reached a score of 5 to 1 to keep Robinho in prison. There is one vote missing for a majority in this regard — in total, the STF has 11 ministers.
Robinho has been imprisoned for eight months in Tremembé, in the interior of São Paulo. The former player is serving a nine-year prison sentence for gang rape for which he was convicted in the Italian courts. The crime occurred in 2013, when he was one of the main players for Milan, in Italy.
In her vote, Cármen Lúcia states that “impunity” for crimes like this is “more than a lack of care, it is a permanent incentive for the continuation of this state of affairs”.
“Women all over the world are subjected to crimes like the one we are dealing with here, causing harm of undeniable intensity to those who are the direct victims, and also to the indirect victims, which is each and every woman in the world, in a culture, which is still unfortunately present, of violating the dignity of all”, says the minister.
“Impunity for the practice of these crimes is more than a sign of neglect, it is a permanent incentive to continue this state of affairs of inhumanity and cynicism, established against all women in every corner of the planet, despite the mandatory legal norms of respect for the right to a dignified life of all human beings”, the vote continues.
The following voted in favor of continuing the prison sentence: Luiz Fux, Luís Roberto Barroso, Cristiano Zanin, Edson Fachin and Cármen Lúcia.
Minister Gilmar Mendes voted for release.
In his vote, he defended the suspension of the process of homologation of a foreign sentence in progress at the Superior Court of Justice and the decision that confirmed the execution of the sentence.
The minister stated that the Migration Law, which dates back to 2017, could not have been retroactively applied and used in Robinho's case, since the crime occurred in 2013.
