Children of Italians born outside the country — including those of naturalized parents or Italian descendants — are being excluded from the right to Italian citizenship. The measure, which has already begun to be applied, is a result of the changes introduced by Legislative Decree No. 36, of March 28, 2025, converted into Law No. 74, of May 23.
The new rules modify Article 14 of Law 91/1992 and create an unprecedented distinction: only minors born in Italy after their parents' naturalization will have automatic citizenship rights. Those born abroad, even if they have lived in the country since childhood, are excluded.
This change has even affected siblings within the same family — one with recognized citizenship, the other with their request denied — and raises questions about... constitutionality of the rule and its social impacts.
To discuss the legal and political effects of this exclusion, The online seminar “Cittadinanza negata” will be held on November 20, 2025.From 15 PM to 18 PM, with free participation and open to the public.
The event is promoted by organizations such as Spazi Circolari, ASGIAMelting Pot Europa, Italiani senza Cittadinanza and ActionAid Italia. The mediation will be done by Chiara Aliberti, from the Melting Pot portal.
Participating in the debate are lawyers Federica Remiddi and Salvatore Fachile, activist Fioralba Duma (Italiani senza Cittadinanza), and campaign coordinator Antonio Liguori (ActionAid Italia).
Among the topics under discussion are:
- An analysis of the new article 14 of Law 91/1992, in conjunction with article 3-bis, and its practical implications;
- Recent cases of citizenship denials for minors born abroad;
- The legal, social, and family consequences of applying the new rules;
- Possible strategies for legal challenge and political and social mobilization.
The exclusion is already being formalized by Italian municipalities based on guidelines from the Ministry of the Interior. These refusals increase the legal insecurity of children and adolescents, many of whom are integrated into Italian society but now lack recognition of their legal ties to the country.
