The idea that the municipality, or comune, has a period of 180 days to transcribe the Italian certificate after recognizing citizenship has gained popularity, but it is nothing more than a myth.

The 180-Day Myth: Debunking the Transcription Deadline

Many Italian descendants believe that the municipalities have up to 180 days to complete the transcription of the certificates, but the Italian legislation does not establish an official deadline.

Processing time depends on the structure and resources of each comune, ranging from weeks to several months.

How to act when faced with delays?

If you experience delays, start by contacting the comune, preferably via PEC (certified email). If there is no response, please wait between six and seven months before considering tougher action.

A common strategy is to send a “diffid”, an unofficial, mandatory notice requiring that the transcription be completed. Written in legal language, this request usually puts pressure on the comune to act before the case escalates to legal action.

When to seek justice?

If administrative attempts fail, the next step is to trigger the TAR (Regional Administrative Court) of the region where the comune is located. Unlike citizenship recognition actions, here the objective is to force the comune to complete the transcription.

The process involves court costs and attorney fees, which often encourages the comune to settle the case before it reaches court. However, this approach can backfire: litigation can strain the relationship with the comune, which will continue to manage future steps, such as updating the AIR (update of address at the consulate) of the applicant at the consulate.
