The process of Italian citizenship one of the main steps is assembling the document folder, which will prove your link with the Italian ascendant.
The list of documents is not very long, but one or another certificate will have to be added to the folder, depending on the route chosen.
Assuming that the Italian in the lineage is your great-grandfather, the list of basic documents – in accordance with the Circular K28 – is as follows:
Great-grandfather (Italian):
- Italian birth certificate (Estratto dell'atto di nascita)
- Marriage certificate (in Italy or Brazil)
- Death certificate
- Negative Certificate of Naturalization.
Grandmother:
- Birth certificate
- Wedding certificate
- Death certificate (if applicable)
Well:
- Birth certificate
- Wedding certificate
- Death certificate (if applicable)
Child (you, the applicant):
- Birth certificate
- Marriage certificate (if applicable)
After these documents are gathered, they are rectified if necessary, and translated into Italian through a Sworn Translator.
It is worth remembering that the certificates must be in full content, that is, complete and with public faith, duly registered at a notary's office. All these details are important so that the process is not denied.
By law, they are valid for six months after they are issued.
Documents for citizenship via marriage
Spouses (wife or husband) of Italian citizens also have the right to Italian citizenship. The request can be made in Brazil or Italy.
In Brazil, the process can begin when the couple completes 3 years of marriage, or 1 year and 6 months if the couple has children.
In Italy, you must have been married for 2 years, or 1 year if you have children. However, only residents of the country will be able to apply.
In both Italy and Brazil, the applicant must be fluent in the Italian language and present a certificate of proficiency – at least B1.
For weddings held before April 27th 1983, wives have automatic recognition of the Italian citizenship, as long as the husband's citizenship is duly recognized.
However, the woman loses her citizenship recognized in this way if her husband died before the same date: April 27, 1983.
The same rule applies to divorces that occurred in Italy before that date.
The wife also does not have the right to citizenship if her Italian husband was naturalized as a Brazilian before 19 May 1975. If naturalization occurred later, she has the right to Italian citizenship.
please note that stable union is not valid for obtaining Italian citizenship. If the union is converted into marriage, the deadlines of 3 years or 1 and a half years (for couples with children) remain the same.
For the process of Italian citizenship maternally, the necessary documents are:
- Birth certificate
- Criminal Record Certificate from the Brazilian Federal Police (document must be presented in original)
- Criminal Record Certificate from the countries in which the applicant has lived after the age of 14
- Proof of address
- Marriage certificate (Estratto per riassunto dai registri di matrimonio), in original
- Certificate of proficiency at level B1 of the Italian language.
