Italy has won a battle against the Airbnb accommodation service at the Court of Justice of the European Union, which declared the tax regime imposed by the country on the platform to be legitimate.
O Airbnb had sued the EU court over a 21% tax created by the Italian government in 2017 to tax bookings in “short rental” services.
Targeting the American multinational, the rule was established after pressure from the hotel sector, which complained about privileged tax treatment for services like Airbnb.
However, according to the EU Court of Justice, Italy does not violate European standards by requiring the collection of information and data on rentals made through these platforms and by applying tax at source.
On the other hand, the court said that Airbnb's obligation to designate a “fiscal representative” is a “disproportionate restriction on the freedom to provide services”. (HANDLE).
