A new circular from interior Ministery, sent to all municipalities and prefectures in Italy, establishes stricter measures to verify the effective presence of applicants in Italian territory, in citizenship recognition processes swear sanguinis, through administrative means. The objective is to combat the practice of false residence.
A circular no. 77/2024, signed by the Department for Internal and Territorial Affairs, of Ministry of Internal Affairs, responds to a significant increase in reports of irregularities in citizenship processes by swear sanguinis, especially by descendants of Italians living abroad.
According to the circular that the Italianism had access (see below), the Italian authorities have received an increasing number of requests for certificates of non-waiver to Italian citizenship, many of them coming from small towns and related to individuals who declare that they reside in Italy.
Given this scenario, the Ministry of the Interior decided to act to curb the practice of false residenceThis involves falsely declaring residency in Italy to obtain Italian citizenship through an administrative process that, in theory, would be faster.
New rules
From now on, Italian municipalities will have to require applicants to present proof of application for “permission of soggiorno in attesa di cittadinanza” (residence permit pending citizenship). In addition, they must carry out periodic inspections to verify that the individual is actually residing at the declared address.
A false residence This is considered a serious fraud and can lead to the annulment of Italian citizenship, as well as criminal prosecution for the applicant if proven.
The impact of the new circular
The new circular should mainly impact applicants who were awaiting confirmation of residence by the local police and have already returned to Brazil.
As it is not possible to request the residence permit by proxy or online, thousands of processes can be halted or even cancelled if fraud is proven.

Circular No. 77/2024
Subject: Civil registration of descendants of Italian citizens within the framework of the process of recognition of citizenship jure sanguinis.
This Department has received several complaints regarding problems encountered in the process of recognizing Italian citizenship by descent (jure sanguinis) for descendants of Italian citizens living abroad.
In particular, consular authorities have reported an unusually high number of requests for certificates of non-renunciation of Italian citizenship, submitted by various Italian municipalities, often small ones, as part of applications for recognition of Italian citizenship submitted by descendants of Italian citizens who declare that they reside in Italy.
Some city governments also reported ongoing criminal proceedings due to illegal behavior arising from these procedures.
On this subject, this Directorate has already issued several circulars, the latest being circular no. 23 of March 1, 2023, in which the need to regularly carry out the inspections provided for in art. 52 of Decree of the President of the Republic no. 223/1989 was highlighted, recommending special attention to relevant situations, such as the improper recognition of citizenship jure sanguinis.
In this sense, the need to carry out checks regarding the effective presence of the applicant at the address of residence declared to the civil registry office at the time of filing the application for Italian citizenship is reiterated.
It should also be noted that the declaration of presence allows the foreign citizen to remain regularly in the national territory for a maximum period of three months or, in any case, for the shorter period provided for in the entry visa, after which it is necessary to obtain a residence permit.
Therefore, it is recommended that Municipal Administrations, while the procedure for recognition of citizenship jure sanguinis is ongoing, request the presentation of the receipt of the application for a residence permit for the acquisition of citizenship, as provided for in art. 11, paragraph 1, letter c), of Decree of the President of the Republic no. 394/1999, or another type of permit, if the requirements are met, and that they carry out regular checks on the actual residence of the applicant in the national territory, since the Municipality's competence to verify the possession of the status civitatis is based on this assumption.
That said, Mayors are requested to raise awareness among Trustees on this issue and ensure strict compliance with the guidelines mentioned above.

OGGETTO: Iscrizione anagrafica dei discendenti di cittadini italiani nell'ambito del procedural per il riconoscimento della cittadinanza jure sangunis.
Sono pervenute da più parti segnalazioni a questo Dipartimento relative a criticita risantrate nel procedure di riconoscimento della cittadinanza italiana jure sanguinis in favore di discendenti di cittadini italiani all'estero.
In particolare, viene rappresentato dalle Autorità Consolari n anomalo increment di richieste di attestazioni di non-rinuncia alla cittadinanza italiana, inoltrate da diversi comuni italiani, spesso di piccole dimensioni, nell'ambito di istanze di riconoscimento della cittadinanza italiana presentate da parte di discendenti di cittadini italiani che dichiarano di risiedere in Italy.
Alcune prefetture hanno anche segnalato procedimenti penali pendenti per condotte illecite emerse nell'ambito dei procedimenti in questione.
