Daniel Taddone, member of the General Council of Italians in the World (CGIE), was formally notified for allegedly releasing doctored images, spreading fake news and commit crimes of insult and defamation on social media. The action was filed by the lawyers of businessman Marcelo de Carvalho Fragali, owner of REDETV, and businessman and former deputy of the Italian parliament, Luís Roberto Lorenzato.
According to the document, the publications made on Taddone's profile on Instagram contain “false, offensive, defamatory and hate-inciting content”, directly affecting the reputation of the notifiers. The images are described as “crude montages, without any basis in reality”, created with the aim of “distorting the truth and attacking and degrading the public and personal image” of those involved.
The posts occurred shortly after the approval of Decree-Law 36, which changed points of the Italian citizenship law, on the 20th of May.
The complaint mentions that the publications also affect authorities of the Italian Republic, such as Senator Mario Borghese (May) and Congressman Dimitri Coin (League), amid the political debate over the Decree-Law 36, which modified points of the law of Italian citizenship.
In the document, the lawyers argue that “the actions constitute civil and criminal offenses, subject to judicial liability in both the civil and criminal spheres”, and that “Daniel Taddone's conduct contradicts the ethical, moral and legal principles that the impeccable institution defends”.
The CGIE ethics committee will be notified to assess the initiation of disciplinary proceedings. Lawyers are also preparing lawsuits, with requests for compensation for moral and material damages.
The charges against Taddone are based on the following provisions of the Penal Code:
Art. 139 — Defamation: impute an offensive fact to someone's reputation.
Pain: detention from three months to one year, and a fine.
Art. 140 — Insult: offend someone's dignity or decorum.
Pain: detention of one to six months, or a fine.
§ 2: When committed on social media, the penalty is tripled.
Art. 299 — Ideological falsehood: intentionally insert or alter false information in a public or private document.
Pain: imprisonment of one to five years, in addition to a fine.
In addition to criminal measures, the authors seek compensation for moral and material damages, due to the negative impact of the publications on the personal and professional lives of the notifiers.
