The expectation is that the State Attorney's Office will maintain, in this hearing, the same line already adopted in the process that resulted in Sentence No. 63/2026: to defend the retroactive application of the law and to argue that minors are protected by the deadline granted by the government for registration until 2029.

If this interpretation is confirmed, the State's defense should argue that Law No. 74/2025 did not leave minors unprotected, since the government itself opened a window of opportunity to regularize the situation of these children. The argument would therefore be based on an interpretation consistent with Judgment No. 63, pointing out that the interests of the minors were preserved by the legislative alternative made available.

It's a predictable position, consistent with what the government has previously argued. The question is to what extent the Court will accept this reasoning in the three cases on today's agenda.

The official list released by the Constitutional Court confirms fifteen lawyers for this afternoon's hearing at the Palazzo della Consulta. These professionals represent the plaintiffs, the Italian State, and the Confederation of Italians Abroad in the three cases challenging Law No. 74/2025.

From the applicants' side:

Alfonso Celotto He represents the authors of Ordinance No. 4/2026, originating from Mantua. A Professor of Constitutional Law at Roma Tre University, he has held high-ranking government positions and has produced extensive legal and literary work.

Marco Mellone Acting in Ordinance No. 40/2026, with a PhD in Law and a leading author on Italian citizenship, he became a key figure in challenging the reform. He took the case to the European Court of Human Rights in Strasbourg, alleging violations of fundamental rights in the process that resulted in Judgment No. 63/2026.

Monica Lis Restanio She formally appears in two of the three proceedings, in Ordinances No. 40 and 41/2026. She presides over the AUCI (Associazione Uniti per la Cittadinanza Italiana) and is a member of the IILA, ​​an Italian-Latin American intergovernmental organization. She also participated in the Sezioni Unite of the Court of Cassation in April 2026.

Giovanni Bonato, by Ordinance No. 41/2026, is a lawyer and researcher affiliated with the Université Paris Nanterre. He became known for his analysis “La Grande Perdita della Cittadinanza Italiana”, a landmark study on the legal effects of the reform.

Corrado Caruso, also by Ordinance No. 41/2026, is a full professor at the University of Bologna, coordinator of the institution's Law course, and has previously taught at Yale, NYU, and the Max Planck Institute.

Giovanni Caridi, Riccardo De Simone e Licia Celi The team from Ordinance No. 41/2026 includes all individuals with a solid track record in citizenship recognition processes based on descent. Fabio Cadeddu, Alessandro Vernice e Maristella Urbini They complete the defense in that same process.

Nunzio Pinelli e Giuseppe Pinelli They represent the entity in Ordinances No. 40 and 41/2026.

The Italian Constitutional Court rejected, this Tuesday (9), all requests for intervention in the proceedings that will be discussed from 15 pm at the Palazzo della Consulta. The decision, published this morning by Ordinanza nº 102/2026, excludes the Confederation of Italians in the World and three individual interveners from the hearing. The requests were considered inadmissible in proceedings nº 40 and 41/2026, originating from the Campobasso Court, which question provisions of Law nº 74/2025. The Court understood that the Confederation has only an indirect interest, without fulfilling the requirement of qualified, direct and immediate interest required for participation in constitutional judgments. One of the individual requests was rejected because it was filed only on June 8, considered untimely. The decision was made under the rapporteurship of Judge Giovanni Pitruzzella.

The Italian Constitutional Court is holding a public hearing this Tuesday (9) on the law that changed the rules of Italian citizenship. The hearing begins at 15 pm in Rome, 10 am Brasília time.     I saw that the court decided to cancel the live broadcast at the last minute. Did they really cancel at the last minute, or did they have some technical problem and decide to proceed without the broadcast? Does anyone have this information?
